Federal judge to consider delay of Clean Water Rule implementation

The Clean Water Rule, also known as the Waters of the United States rule, promulgated by the Environmental Protection Agency and the U.S. Army Corps of Engineers, is scheduled to be enforced beginning August 28, but a federal judge in North Dakota was scheduled to hold a hearing today on a case brought by state attorneys general asking for a delay.
Judge Ralph Erickson was scheduled to hear arguments on the injunction in U.S. District Court in Fargo. However, the EPA and Corps still have until Tuesday to file their opposition brief, so Erickson isn’t expected to issue a ruling until the middle of next week, a spokesperson for North Dakota Attorney General Wayne Stenehjem said today, the Grand Forks Herald reported.
