Bloomberg plans to appeal soda ruling

New York Mayor Mike Bloomberg plans to appeal a judge’s ruling that overturned the city’s plan to limit the size of sugary drinks to 16 ounces at restaurants, theaters and food carts, The New York Times reported late Monday.

“I’ve got to defend my children, and yours, and do what’s right to save lives,” the mayor said. “Obesity kills. There’s no question it kills.”

He added, “We believe that the judge’s decision was clearly in error, and we believe we will win on appeal.”

The ruling criticized the rule for inconsistency because it would have allowed large dairy-based sugared drinks to be sold and exempted convenience stores and bodegas.

The beverage industry praised the ruling, but legal experts had differing opinions on how an appeals court might view the ruling, The Times said.
